What Do I Need to Bail Someone Out?

Money:     You pay 15% of the bail amount plus a $50 Court fee (When applicable).

Cosigner:  Any person willing to be responsible to pay the FULL amount of the bail, if the defendant Fails and/or Refuses to Appear in Court. (Responsibilities of the Cosigner is discussed below)

Collateral:  Anything of value (actual cost not sentimental)  to insure that the Cosigner will pay the Premium cost, and the defendant will attend his or her Court date. Collateral is most commonly  accepted with higher bail amount.


ALL BAIL AGENCIES ARE REGULATED TO CHARGE THE SAME PRICE.

Responsibilities of a Cosigner / Indemnitor:

  • Make sure the Defendant appears at all court dates until the case is dismisse​d.
  • To inform the Bonding Agent of any changes is phone numbers, and living locations, until the bond is discharged.
  • To make sure the Agent receives the FULL amount of the premium (15% + $50). 
  • To be Financially responsible to pay the Bail Amount if the defendant refuses to go to court. 
  • To be responsible for all costs the Agency is charged for any cases regarding the Defendants capture and return to court if he fails to appear.

Before You Sign:

It is the responsibility of the indemnitor, typically a family member/close friend of the defendant, to see that the entire premium is paid.  The premium charge (15% plus a fifty dollar court fee) for bail is non-refundable and is considered fully earned upon the defendants release from jail. Other fees that can be charged for the posting of a bond are long distance telephone calls, posing fees, travel fees, or any other incidental expenses.

If The Defendant Fails to Appear:

In the case of a forfeiture (the defendants failure to appear in court) it is the duty of the Indemnitor to pay the full amount of the bail and/or see that the defendant appears in court for reinstatement of the bail and/or locate the defendant to surrender him/her back to custody. This includes medical or transportation problems. If the defendant or Indemnitor moves, it is the responsibility of the Indemnitor to notify the Bail Agent of this change within 48 hours. Failure to do so could result in the surrender of the defendant back to custody of the court. (No premium would be refunded).

If the Defendant Refuses to Appear: 

The law provides that the Indemnitor is liable for all expenses if we need to take legal action. The defendants refusal to return to court can add up expenses such as skip-tracing fees, attorney fees, court costs, and rewards. The Indemnitor is liable for all costs up to the face amount of the bond again. In other words, the Indemnitor could be liable for up to twice

the face value of the bond.
